NSW Compliance Requirements

Understanding your legal obligations as a landlord or STRA host

Residential Rentals

Under the Residential Tenancies Regulation 2019, landlords must:

  • Install smoke alarms on every storey, including in hallways or corridors associated with bedrooms
  • Check alarms are working effectively every 12 months and before each new tenancy
  • Replace alarms within 10 years of manufacture date
  • Repair or replace faulty alarms within 2 business days
  • Use a licensed electrician for all 240V work

Short-Term Rentals (STRA)

Airbnb, Stayz and holiday rentals must meet the NSW STRA Fire Safety Standard:

  • Smoke alarms must be interconnected where more than one is installed
  • Powered by 240V mains or 10-year sealed battery only
  • Heat alarm required in any attached garage
  • A4 evacuation diagrams at the entry and inside each bedroom
  • Fire extinguisher & blanket required for apartment-style dwellings
  • Must register on the NSW STRA Register and renew annually

Compliant Alarm Types

For rental properties in NSW, smoke alarms must be:

  • Photoelectric type (required under AS 3786)
  • Compliant with Australian Standard AS 3786
  • Replaced every 10 years from manufacture date
  • Interconnected where required (mandatory for STRA, best practice for all rentals)

Key Deadlines

Important timeframes to stay on top of:

  • Annual testing required for all rental properties
  • Test within 30 days before each new tenancy or renewal
  • 2 business days to repair or replace a faulty alarm
  • Replace all alarms before their 10-year expiry
